Mission Statement

The Mission of the Neighborhood and Community Advisory Committee is to strengthen and revitalize the City of Pelican Bay and to stabilize and transform our physical, social and economic environment.

Background Information

The Neighborhood and Community Advisory Committee is charged with assisting the city council by reviewing and recommending projects and programs designed to maintain and improve residential and commercial property values throughout the City. The committee will review and provide recommendations to the city council regarding planning & development, community code, beautification and neighborhood revitalization programs and initiatives, parks & recreation revitalization programs and initiatives, and other projects as requested by the City Council. The committee will function as an advisory and recommending body to the city council and will have no role in enforcement or inspection activities, which are the responsibility of duly-authorized city staff.

Membership on this advisory committee is voluntary. Members do not receive any compensation for being on the committee. Appointments are made by the City Council. The procedure for filling vacancies consists of an application followed by interviews of selected applicants by the City Council.

In General

Advisory committees typically invest ten to forty hours per month. Occasionally advisory committees are asked to investigate specific issues or advisory committees may hold work sessions in addition to their regular meetings. Advisory Committee members are expected to thoroughly review agenda materials which they receive prior to meetings. 75%  attendance is the minimum standard expected. Missing 3 consecutive meetings without prior committee approval is grounds for dismissal. Advisory bodies do not have policy making power.  The City Council considers advisory body recommendations when dealing with agenda items.

The Neighborhood and Community Advisory Committee meets the first Tuesday of each month at 6:30 PM. All meetings are open to the public.

Everyone had a great time at the City picnic that was held on Oct 4th, 2008. There was food and fun activities for all. Thank you to the Pelican Bay Volunteers and FBC Briar for making the picnic happen. We are looking forward to another great City event this December. Stay tuned for details.

MINUTES OF THE NCAC SPECIAL MEETING OF JUNE, 2ND, 2008

OFFICIAL MINUTES OF THE SPECIAL MEETING TO ORGANIZE THE
NEIGHBORHOOD AND COMMUNITY ADVISORY COMMITTEE OF PELICAN BAY.

A Special Meeting of the Neighborhood and Community Advisory Committee of the City of Pelican Bay was held on Monday, June 2, 2008 starting at 6:30 p.m. in the City Hall at 1300 Pelican Circle, Pelican Bay, Texas, at which time the following subjects were discussed:

1.      CALL TO ORDER.
Meeting was called into order at 6:36 PM by the Ex Officio, Larry Leach. Also present were, Marvis Diggs, Troy Diggs, James Buel, Estelle Buel, Brenda Scott, Larry Wells, Clifford Tynes, Gary Clark.

2.      PLEDGE OF ALLEGIANCE.
The pledge was led by the Ex Officio, Larry Leach

3.      REVIEW THE “RULES OF ORGANIZATION” WITH THE REGULAR COMMITTEE MEMBERS THAT ARE PRESENT.
Copies of the “Rules of Organization” were handed out to all regular committee members present. Time was allowed for all members to review the “Rules of Organization”  and provided attachments that explained the Open Meetings law and Roberts Rules of Order.

4.      REVIEW,  DISCUSS AND VOTE ON THE APPOINTMENT OF THE VOTING “ADVISOR” MEMBERS TO THE NEIGHBORHOOD AND COMMUNITY ADVISORY COMMITTEE FOR PLACES 1, 2, 3, 4, 5, AND 6. THIS WILL BE BY A RANDOM DRAWING OR OPEN VOTE BY COMMITTEE MEMBERS. TOTALS WILL BE TALLIED AND VERIFIED BY THE EX OFFICIO AND AND ONE OTHER WITNESS.
It was decided by the regular members present to add two additional seats for a total of 8 voting “Advisor” members of the NCAC
committee. After a discussion, it was settled as to who would be seated in which place.

5.      SEAT THE VOTING “ADVISOR” MEMBERS
Place 1 - James Buel, Place 2 - Estelle Buel, Place 3 - Marvis Diggs, Place 4 - Gary Clark, Place 5 - Troy Diggs, Place 6 - Larry Wells, Place 7 - Clifford Tynes, Place 8 - Brenda Scott

6.      ROLL CALL AND DECLARE QUORUM.
The Ex Officio, Larry Leach conducted the roll call. Present were: James Buel, Estelle Buel, Marvis Diggs, Gary Clark, Troy Diggs, Larry Wells, Clifford Tynes and Brenda Scott.

7.      REVIEW, DISCUSS AND VOTE ON THE APPOINTMENT OF THE CHAIRMAN AND VICE CHAIRMAN.
Larry Wells made a motion to appoint Marvis Diggs as Chairman, James Buel seconded. Motion passed 8/0
Marvis Diggs made a motion to appoint Larry Wells as Vice-Chairman, James Buel seconded. Motion passed 8/0
Both Chairman and Vice-Chairman were congratulated. Chairman, Marvis Diggs and Vice-Chairman, Larry Wells appointed
Clifford Tynes to be NCAC’s Secretary. The power to appoint a Secretary by the Chairman and Vice-Chairman was granted according to the “Rules of Organization” so no formal committee vote was necessary.

8.      REVIEW, DISCUSS AND VOTE ON ACCEPTING THE CITY COUNCIL’S PROJECT   TO PLAN, RESEARCH, AND CREATE DRAWINGS AND SPECIFICATIONS FOR A MUNICIPAL COMPLEX BUILDING.
After a discussion, a motion was made by Gary Clark to accept the City Council’s project. The motion was seconded by Marvis Diggs. Motion passed 8/0

9.      OPEN DISCUSSION
There was some discussion about scheduling a workshop to meet and plan with both the Fire and Police Chiefs on the municipal complex. The Chairman, Marvis Diggs said he plans to call a meeting in the near future.

10.      ADJOURNMENT.
A motion was made by Marvis Diggs to adjourn. The motion was seconded by James Buel. Motion passed 8/0
The meeting was adjourned at 8:15 PM.

The Neighborhood and Community Advisory Committee formed

On June 2nd, 2008 the Neighborhood and Community Advisory Committee was officially formed.

Place 1 - James Buel, Place 2 - Estelle Buel, Place 3 - Marvis Diggs, Place 4 - Gary Clark, Place 5 - Troy Diggs, Place 6 - Larry Wells, Place 7 - Clifford Tynes, Place 8 - Brenda Scott.

Places 7 and 8 are alternates.

The Neighborhood and Community Advisory Committee (NCAC) has been formed. The first meeting will be held on Monday, June 2nd, 2008 @ 6:30 PM. The location will be the City Hall and the meeting will be open to the general public. The first line of business will be to organize and select the voting members, The Chairman, Vice Chairman and Secretary.

The Following Applications for the NCAC have been approved:

Clifford Tynes, Marvis Diggs, Troy Diggs, Gary Clark, James Buel, Estelle Buel, Larry Wells, Brenda Scott

Congratulations to the new members and thank you for working to make Pelican Bay a better home for all of us!

The NCAC is looking for additional members. Please stop by the City Hall and fill out a application.

The City Council has given the project of researching, planning and designing of the Municiple Complex to the NCAC Committee.  The goal of this project is to plan a basic but fuctional complex to house both the Police and Pelican Bay Fire/Rescue. Previously, the City Council approved up to $100,000 from the Gas Mineral Rights upfront monies that the City Receivied along with a loan of no more than $50,000. The City Auditor is exploring other options for low interest loans which might allow the City to finance the building without having to use the entire amount of the $100,000 that was allocated. Once the Citizen advisory committee completes this project, it will be put to the council for vote. We hope this will be the first of many Citizen involved projects.

Dock Area Clean-Up

The Planning and Development Committee was the idea of Councilman, Calvin Hunter. I briefly served on the committee prior to being appointed to the city council to fill a unexpired term after Stassie Rainwater resigned. The committee is made of private citizens who either own property in or reside in Pelican Bay. Larry Wells, Marvis Diggs and Clifford Tynes are current members on this Committee.

Note: The committee will be changing names to the Neighborhood and Community Advisory Committee

The Committee meetings are open to the public and all citizens and their families are welcome to participate in the events as long as the children are supervised.

As a private citizen, I was the primary organizer of the first Dock area clean-up effort prior to Calvin Hunter forming the Planning and Development Committee. The clean-up event I helped organize had a good turn-out and was very successful. Current and former mayor’s of the city contributed to the effort by participating or donating food and drinks or supplies to the event. It was truly a community effort where everyone set aside their differences and came together for a good cause. I am proud of everyone who participated and appreciate their donations and hard work.



I fully support the efforts of this Committee to clean-up Pelican Bay and to bring new development, public parks and citizen activities and events to the city. I have personally volunteered and participated in every single one of these clean-up events. Council Members, Missy Clark and Calvin Hunter have participated in every one of the events as well. The mayor, Sandy Tolbert has been at a couple of the events. Council Member, Joe Davis has not participated due to health reasons but donated drinks for the first event. We have a new improved children’s park thanks to the efforts of Renee McWhorter and other hard working volunteers. It’s this kind of dedication and caring that I’m proud of. “Together, We can make a difference”.

I will be personally organizing one of the future events to see if we can get a better turn out. With the weather improving and plenty of advanced notice, we should have another successful event.

I encourage everyone to volunteer a few hours of their time to help better our community.

Dear Citizens,

I was selected by the city council to be the Ex Officio for the new Neighborhood and Community Advisory Committee. As the Ex Officio, I will be the advisory committee’s contact and will work with the committee to get items placed on the city council’s agenda for  consideration. I will not be managing or otherwise directing the actions of the committee. The committee will be working independently. Occasionally, the city council may make a request of the committee to investigate or make recommendations on a issue. I will place these items on the Advisory Committee’s agenda for their consideration.

The committee will be made up of citizens, Pelican Bay Business Owners, and Pelican Bay Property owners. It’s important that we have a good representation of people who all have the same desire, which is to make Pelican Bay a better place for all of us. Even if you rent in Pelican Bay, you are a resident citizen and may serve on this committee, so please fill out an application.

I also want to mention that while the Neighborhood and Community Advisory Committee might organize and participate in clean-up events, the mail purpose is to identify and help find solutions to our citizen’s concerns.  It’s to help the city get a plan in place for the future development of Pelican Bay. It’s up to all of us to work together to make Pelican Bay a better place to live, work and play.

As a citizen, I plan to participate in projects and volunteer efforts that are organized by this committee and I hope you will too.

ORDINANCE CREATING NEIGHBORHOOD AND COMMUNITY ADVISORY COMMITTEE

AN ORDINANCE OF THE CITY OF PELICAN BAY, TEXAS CREATING A NEIGHBORHOOD AND COMMUNITY ADVISORY COMMITTEE; PROVIDING FOR THE COMPOSITION AND APPOINTMENT OF MEMBERS TO THE COMMITTEE AND OTHER PROCEDURES FOR THE COMMITTEE; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, all communities including the City of Pelican Bay develop expectations regarding the aesthetic character of the City and desire to ensure neighborhood stability and integrity; and

WHEREAS, maintaining and improving property values in residential neighborhoods and commercial districts is a desirable and important goal; and

WHEREAS, City codes and policies are an important part of maintaining and revitalizing the
Pelican Bay community, along with the possible creation of programs currently used by other cities designed to assist homeowners, such as a Good Neighbor Program, a Paint Up the city program, a Employee Giving Day, and Housing Rehabilitation Programs; and

WHEREAS, developing and maintaining Parks & Recreational areas are in the best interest of the Citizens of Pelican Bay.

WHEREAS, the orderly Planning & Development of Pelican Bay may be obtained by the development of city-wide and neighborhood plans and programs. Including the creation, adoption, and maintenance of a General Plan and General Plan Map.

WHEREAS, the City Council of the City of Pelican Bay desires to create an advisory board to assist the City Council in meeting its expectations regarding the aesthetic character of the City, and to encourage citizen and business input, communication and effort on such issues;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PELICAN BAY, TEXAS:

Section 1:
THAT a new article be added to the Pelican Bay Code of Ordinances which shall read as follows: “ARTICLE.  NEIGHBORHOOD AND COMMUNITY ADVISORY COMMITTEE . Created.

There is hereby created a Neighborhood and Community Advisory Committee for the City of
Pelican Bay.

Section 1-a. Purpose
The Neighborhood and Community Advisory Committee is charged with assisting the city council by reviewing and recommending projects and programs designed to maintain and improve residential and commercial property values throughout the City. The committee will review and provide recommendations to the city council regarding planning & development, community code, beautification and neighborhood revitalization programs and initiatives, parks & recreation revitalization programs and initiatives, and other projects as requested by the City Council. The committee will function as an advisory and recommending body to the city council and will have no role in enforcement or inspection activities, which are the responsibility of duly-authorized city staff.

MISSION STATEMENT

The Mission of the Neighborhood and Community Advisory Committee is to strengthen and revitalize the City of Pelican Bay and to stabilize and transform our physical, social and economic environment.

Section. 1-b. Appointment of members; term; composition
The Neighborhood and Community Advisory Committee shall be made up of six (6) voting
members comprised of Pelican Bay citizens, Pelican Bay business owners and or Pelican Bay property owners, appointed by the City Council. A city council member will be appointed by the majority vote of the city council, to serve as an ex officio member.

Members will be appointed for a term of two (2) years. Places 1, 3, and 5 will be appointed for
an initial 2-year term. Places 2, 4 and 6 will be appointed for an initial 1-year term and then for
subsequent 2-year terms.

All members shall be appointed by majority vote of the City Council and may be removed by majority vote of the City Council with or without cause. Vacancies in the Committee occurring other than by expiration of term shall be appointed by majority vote of the City Council for the remaining portion of the term.

The composition of the Committee will be as follows:

After the Committee is appointed, it shall meet and organize.

Section. 1-c. Meetings; Quorum.
Meetings shall be held every month on the first Tuesday. Special meetings may be called
as necessary. All meetings of the committee will be held in full compliance with the Texas Open
Meetings Act. A majority of the voting members shall constitute a quorum.

Section. 1-d. Chair and Vice-Chair.
The committee shall select a chair and vice-chair. The chair shall preside over meetings of the
committee; and in the absence of the chair, the vice-chair shall preside.”

Section, 1-e. Secretary.
The committee shall select a Secretary. The Secretary shall create agendas, cause notice of meetings to be posted, and record minutes of the meetings of the committee; and in the absence of the Secretary, the Chair or Vice Chair will fill the duties of the Secretary.”

Section, 1-f. Agenda.
Any committee member or the Ex Officio may place items on the agenda.

Section 2:
THAT it is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance
since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.

Section 3.
THAT this ordinance shall become effective immediately upon final passage. AND IT IS SO ORDERED.
